Terms of Service
Please read these terms carefully before using any Tienko platform.
1. Acceptance of Terms
By accessing or using any website, application, or service operated under the Tienko ecosystem — including tienko.io, tienko.market, tienko.exchange, tienko.ltd, thetokengame.com, thetokengame.xyz, thegoldtokengame.com, thepeoplegame.io, and curator.ltd (collectively, the "Platforms") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Platforms. These Terms constitute a legally binding agreement between you and Tienko.
2. Eligibility
You must be at least 18 years of age to use the Platforms. By using the Platforms, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and are not prohibited from using the Platforms under the laws of your jurisdiction. The Platforms are not available to residents of jurisdictions where the use of blockchain-based applications or digital assets is prohibited.
3. Description of Services
Tienko operates a blockchain-based gaming and digital asset ecosystem. The Platforms provide: (a) a collectible coin game featuring 104 digital coins across 13 nations; (b) tools for minting, trading, and managing Solana SPL tokens; (c) a community stash prize pool funded by platform fees; (d) a progressive journey system tracking cross-platform activity; (e) community features including voting, leaderboards, and player profiles; and (f) informational and educational content about tokenomics and blockchain technology. The Platforms do not constitute a regulated financial exchange, investment platform, or securities broker.
4. Wallet and Account
Access to the Platforms is provided through a compatible Solana wallet (such as Phantom). You are solely responsible for the security of your wallet, private keys, and seed phrases. Tienko does not have access to your private keys and cannot recover lost wallets or funds. Your wallet address serves as your universal identity across all Tienko Platforms. Any activity conducted through your wallet address is your sole responsibility.
5. Prohibited Conduct
You agree not to: (a) use the Platforms for any unlawful purpose or in violation of any applicable laws; (b) attempt to manipulate coin prices, voting systems, or leaderboards through artificial means; (c) use automated bots, scripts, or other tools to interact with the Platforms without prior written consent; (d) impersonate any person or entity; (e) attempt to gain unauthorised access to any part of the Platforms or their infrastructure; (f) engage in money laundering, fraud, or any other financial crime; (g) use the Platforms in any manner that could damage, disable, or impair their operation.
6. Digital Assets and Tokens
Coins and tokens on the Platforms are digital collectibles and game assets. They are not securities, investment contracts, or financial instruments. Tienko makes no representations about the value, liquidity, or future utility of any digital asset on the Platforms. The minting, trading, and holding of digital assets involves significant risk, including the risk of total loss. See our Risk Disclaimer for full details.
7. Fees and Payments
Certain actions on the Platforms, including minting coins, may require payment of fees in SOL or other digital currencies. All fees are non-refundable unless otherwise stated. Network transaction fees (gas fees) are determined by the Solana network and are beyond Tienko's control. The Stash prize pool is funded by a 1% fee on trades conducted through tienko.exchange. Distribution of Stash funds is governed by the Stash rules published on the Platforms.
8. Intellectual Property
All content on the Platforms, including but not limited to text, graphics, logos, coin artwork, game mechanics, and software, is the property of Tienko or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platforms for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent.
9. Disclaimer of Warranties
THE PLATFORMS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TIENKO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TIENKO DOES NOT WARRANT THAT THE PLATFORMS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIENKO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORMS, EVEN IF TIENKO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TIENKO'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO TIENKO IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Tienko and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platforms, your violation of these Terms, or your violation of any third-party rights.
12. Termination
Tienko reserves the right to suspend or terminate your access to the Platforms at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Platforms will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tienko is registered, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platforms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.
14. Changes to Terms
Tienko reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by posting a notice on the Platforms. Your continued use of the Platforms after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
